The Terms and Conditions below apply to the Saltrock website: www.saltrock.com (“Website”) in connection to your use of our Website (“Terms”).  (Separate Terms and Conditions apply to our in-store trading).

These are the Terms for Saltrock Surfwear Ltd which is a company incorporated in England and Wales with registered number 11518832 and whose registered office is at Saltrock House, Velator, Braunton, North Devon, EX33 2DX (also referred to as “our”, “us”, “we” or “the Company”). 

 The Company’s VAT registration number is 302 3271 57.

 

SUMMARY OF YOUR KEY RIGHTS

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“CCR”) say that up to 14 days after receiving your Products, in most cases, you can change your mind and get a full refund.

The Consumer Rights Act 2015 (“CRA”) says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product, you’re entitled to the following:

·       up to 30 days: if your Products are faulty, you can get a refund;

·       up to six months: if Products can’t be repaired or replaced, then you’re entitled to a full refund in most cases;

·       up to six years: if the Products do not last a reasonable length of time, you may be entitled to some money back.

Website Sales Terms and Conditions 

1.1. Welcome to our Website. We hope that you have found it easy to use and to navigate.  If you continue to browse and decide to use our Website then you are agreeing to be bound by the following terms and conditions (“Terms”).  These Terms are here to protect both of us in your on-line shopping experience and they also incorporate all of your statutory rights. Please read these Terms carefully before you place any orders on the Website. They may seem a bit technical but we have tried to make them as easy to understand as possible.  If you find anything that you don’t think makes sense, then please do send an email to our customer services department.  They are there to help.

1.2.          For the purposes of these Terms, you are a ‘consumer’ if you are buying from the Website as an individual for purposes wholly or mainly outside of your trade, business, craft or profession. You are a ‘business customer’ if you are buying from the Website for purposes relating to your trade, business, craft or profession. Some terms only apply to your order if you are a consumer and other terms only apply to your order if you are a business customer, so please make sure you read these Terms carefully.

1.3.        We may modify these Terms from time to time. The version that applies to your order will be the version in force at the time you place your order.

1.4.          Your contract to buy goods, created in accordance with these Terms, is with Saltrock Surfwear Ltd. You must be at least 18 years old and a resident of the UK to place an order on the Website. If you are a business customer placing an order on behalf of a business, you confirm that you have authority to place such order for and on behalf of that business. You promise that you are at least 18 years old and have the legal right and ability to enter into a contract with the Company and to use any debit or credit card used to purchase the goods. You also promise that all information you have provided is accurate and true. You authorise us to perform validation checks and authorisation with the card issuer.

1.5.          In addition to these Terms, your purchase is governed by our Privacy Policy. If you are under 18 years of age you must inform a parent or guardian that you are using the Website and let them know about our Privacy Policy before you register with us.

1.6         Please print out or save a copy of these Terms and any emails from us for your records, as we will not save or file a copy for you. These Terms are only available in English.

2. Registration with us

2.1.          To use some of our services you will need to register with us although a guest check out is also available. When you register, you will need to choose a username and a password.  Please keep your password safe and never let anyone else use your username and password to make purchases from us.  If you think anyone knows your password then change it straight away. 

2.2.          We will keep all of your registration information (“Personal Information”) safe and deal with it in accordance with our Privacy Policy.

3.  Placing an Order with us and our Acceptance

3.1.          We really hope you love our clothes and accessories.  When you place an order, this is what you need to know.

(a)         when you place your order all the information that you give us must be accurate and complete. Please check your order carefully and correct any errors before you submit it to us;

(b)        all orders placed are subject to acceptance by us and product availability. We cannot guarantee that any Products will be available at any given time;

(c)         once you have clicked the “confirm” button things our side move quickly.  For that reason, we cannot guarantee being able to amend or cancel it. This does not affect your statutory “cooling off” rights, which you can read about in these Terms. If you do wish to amend your order or cancel it once you have clicked “confirm” then the best thing to do is to call our customer service team who will try to help. You can reach them on +44(0)1271 446 378; and

(d)         once you have placed your order you will receive an email acknowledging receipt of your order and providing the details of your order.  This does not mean that your order has been accepted by us. Acceptance of your order takes place when we send you an email confirming that your order has been dispatched, at which point a legally binding contract is formed.  Please check all of the information on this email is correct and if it is not, please notify us as soon as possible. You may then receive further delivery and tracking updates from the relevant postal or courier provider. Please check all information in the order acknowledgement email carefully and notify us as soon as possible if anything is incorrect.

3.2.        We reserve the right not to accept your order, process your transaction or refuse to provide a service to you where reasonably necessary. We will not be held liable to you or any third party for withdrawing our stock from our Website, refusing to process a transaction or unwinding or suspending a transaction after the processing has begun.

3.3.        If there is a problem with your order e.g. a problem with your credit card or we do not have the Products ordered in stock, and we cannot accept the contract, we will notify you by email. If we do not accept your order, for example because we are unable to take payment, what you’ve ordered is unavailable, you are under 18 or live outside of the UK, or there has been a mistake regarding the pricing or description of the Products, we will email you using the details you provided when you placed your order. We have the right to reject any order for any reason.

3.4.        In certain circumstances beyond our reasonable control, for example where there has been a change in law, we may need to stop supplying certain Products. If this happens and it affects your order, we will notify you by email, cancel your order and in respect of any affected Products, provide you with a full refund (including any delivery costs, if applicable).

4.  Price and Payment

4.1.          All prices stated on the Website are inclusive of VAT where applicable, but exclusive of shipping charges, unless we tell you otherwise. Prices and availability of Products may be changed at any time without notice. The price at which you agree to purchase the Products is the price stated on the Website at the time you place your order. Prices in our retail stores and outlets may be different to the prices shown on the Website. Promotions are calculated from this rate and in conversion to other currencies may alter the end offer price.

4.2.        All prices are in pounds sterling (£) (GBP).

4.3.        If there has been an error on the Website regarding the pricing of any of our Products and this affects your order; we will try to contact you using the contact details you provided when you placed your order. We will give you the option to re-confirm your order at the correct price or to cancel your order. If we are unable to contact you, we will treat the order as cancelled and notify you by email.

4.4.        We will take all reasonable steps to ensure that your credit or debit card information is kept secure. However, unless we have been negligent, we are not liable for any losses arising from unauthorised access by a third party to your confidential information.

4.5.        Any Products you buy from us must be paid for in advance. Payment will be taken from your card at the time you place your order.

4.6.        If we are unable to take payment from your card, we will cancel your order and notify you by email.

4.7.        Payment can be made by Visa, Visa Electron, MasterCard, Delta and Maestro debit cards, Paypal, Apple Pay and Google Pay. Payment by card will be debited and cleared from your account upon receipt of your order by us. We also facilitate purchases via Amazon. Any purchases made on the Amazon website are subject to these terms and conditions of sale.  The use of promotional codes to reduce the on line advertised price are entirely at our discretion and in some cases may not be used in association with other offers.

4.8.       All debit and credit card payments are subject to validation and authorisation by the relevant card issuer. If for any reason the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery to you.

4.9.        Klarna

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment options. Payment is to be made to Klarna:

5. Delivery

5.1.       Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or other occurrences beyond our control for which we will not be responsible.

5.2.       Delivery of the Products will occur when we deliver them to the address you provide us with when you make your order. You are responsible for the Products when delivery has taken place.

5.3.      If no one is available to take delivery, we will post an attempted delivery notification through your letterbox with information on how to re-arrange delivery or follow the delivery instructions you provided to us (e.g. leaving it in a specified safe location or delivering it to a neighbour or nearby business) and post a delivery note through your letterbox or email you to let you know where we have left your package. If a further delivery attempt is unsuccessful or we are unable to follow your delivery instructions, we will notify you by email, cancel your order and refund you the price of the Products (but not the delivery charge).

5.4.        Please examine the Products as soon as reasonably possible after delivery and notify us of any fault or damage as soon as reasonably possible.

5.5.        Once your order has been delivered to your address or in accordance with the delivery instructions you provided to us, the risk in the Products passes to you and the Products are classed as having been ‘delivered’. This means that you are responsible for the Products and we are not liable to you if the Products are stolen or damaged after they have been delivered to you. This does not affect your legal rights if the Products are faulty or misdescribed. Ownership of the Products passes to you once you have paid for them in full.

5.6.        Your Products will be delivered on the selected delivery date or within the delivery period specified, depending on the delivery option you chose when you placed your order. We will deliver your order within 30 days of the order confirmation email unless otherwise agreed between you and us.

5.7.        Any delivery dates stated during the order process, or in your order acknowledgment or order confirmation emails, are estimates, unless we have agreed a specific delivery date with you.

5.8.        Next day delivery means that orders are processed as a priority and shipped for the next working delivery day. If your order is made before 3:00pm (GMT), it will be shipped for arrival the next working day. 3:00pm (GMT) is an approximate cut of time and on occasion some parcels may be shipped the same day when ordered after 3:00pm GMT, you will be notified if this happens.

International Orders

5.9.       Due to customs, legal, regulatory and certain practical restrictions applicable to orders placed for international delivery, some of our Products may not be available for delivery to certain destinations outside the UK. We reserve the right to define what can and cannot be delivered to which destination.

5.10.       Purchases will be made in Pounds Sterling. International credit card providers or banks will determine the exchange rate and may add an additional processing or administration charge in relation to such payment which international credit card holders will be liable to pay.

5.11.       All Products are sold on a delivery duty unpaid basis (DAP). You may have to pay import duty or a formal customs entry fee prior to or on delivery. Additional taxes, fees or levies may apply according to local legislation and customers are advised to check these details before placing an order for international delivery.

6. Delays

6.1.       Where the supply of your Product(s) is delayed or prevented for reasons beyond our control, we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.

7. CONSUMER CANCELLATION RIGHTS

7.1.        This clause only applies to you if you are a consumer.

7.2.        Except in the circumstances listed below, you have the right to change your mind and cancel your order within 14 days of receiving your Products. Please see Our Returns and Exchange Policy | Saltrock Surfwear for more information.

7.3.        You do not have the right to cancel orders for personalised goods. You also lose your right to cancel if you remove or break a protective or hygiene seal attached to any Products.

7.4.        To cancel your order, please follow our returns procedure set out in Our Returns and Exchange Policy | Saltrock Surfwear. To help us process your cancellation more quickly, please have your order number ready or include it in the email or cancellation form you send to us.

8. RETURNING GOODS IF YOU CANCEL AN ORDER

8.1.        This clause only applies to you if you are a consumer.

8.2.        If you cancel an order for Products and you have already received your order, you must return the Products in accordance with Our Returns and Exchange Policy | Saltrock Surfwear. Unless the Products are faulty, incorrect or misdescribed, you will be responsible for the direct cost of returning the Products to us. We may deduct a returns handling charge from your refund where this is stated in Our Returns and Exchange Policy | Saltrock Surfwear.

8.3.        We strongly recommend that you obtain proof of postage when returning Products to us. We may withhold any refund until we have received the Products back from you or until you have provided us with evidence that you have sent the Products back (whichever is earlier).

8.4.        Products must be returned to us in a new and unused condition and, to the extent possible, in their original packaging. You are responsible for the Products while they are in your possession.

9. REFUNDS IF YOU CANCEL YOUR ORDER

9.1.        This clause only applies to you if you are a consumer.

9.2.        If you exercise your right to cancel, we will provide you with a refund as soon as possible and, in any event, within the timescales required by applicable law.

9.3.        If you cancel an order for Products and have already received them, we will issue the refund no later than 14 days after the day we receive the Products back from you or, if earlier, the day on which you provide us with evidence that you have sent the Products back. Otherwise, we will issue the refund no later than 14 days after the day on which you told us that you want to cancel.

9.4.        Your refund will include the cost of standard delivery originally paid by you, if applicable, but will not include:

(a)         any additional costs arising if you chose a delivery option more expensive than our standard delivery service; and

(b)         any return postage or returns handling charges payable under Our Returns and Exchange Policy | Saltrock Surfwear, except where the Products are faulty, incorrect or misdescribed.

9.5.        If you handled the Products in a way beyond what might reasonably be permitted in a shop and this resulted in a loss in value of the Products, we may take a deduction from the refund for such loss in value.

9.6         We will issue your refund to the same payment method you used when you placed your order.

9.7.        If the right to cancel does not apply because of one of the circumstances listed above, you will not be entitled to a refund unless the Products are faulty. See clause 10 below.

10. FAULTY PRODUCTS

10.1.     This clause only applies to you if you are a consumer.

10.2.     Any Products that we provide to you must be as described, fit for purpose and of satisfactory quality.

10.3.     We are under a legal duty to supply Products that are in conformity with our contract with you.

10.4.     During the expected lifespan of any Products that you have purchased from us, you are entitled to the following:

Up to 30 days:

If your Products are faulty, you can get an immediate refund.

Up to six months:

If the Products cannot be replaced, then you are entitled to a full refund in most cases.

 

 

Up to six years:

If the Products do not last a reasonable length of time, you may be entitled to some money back.

10.6.     If there is a problem with any Products you have purchased from us, please contact us as soon as reasonably possible.

11. Mailing List 

11.1.       To keep you up to date with our latest products, news, promotional offers and events we may contact you by email or post. If you do not want to receive our offers and promotions by email or post, you can unsubscribe by clicking the unsubscribe button on any of our promotional emails or by emailing customerservice@saltrock.com.

11.2.     Please note that it can take up to 7 days to fully remove you from our email mailing list so you may continue to receive emails whilst your request is being processed.

11.3.     Any promotional printed material is printed in advance so you may also receive a mailing whilst your unsubscription is being processed. If you have any further questions, please contact us at customerservice@saltrock.com.

11.4.     Please note that service emails relating to your account and order cannot be unsubscribed from and will continue to be sent. 

12.         Privacy and Cookies

12.1.       We will treat all of your Personal Information as confidential and any personal information you provide to us will be dealt with in line with our Privacy Policy.  We will only disclose this information as required by law. We will keep your Personal Information on a secure server and we will fully comply with all applicable UK Data Protection and consumer legislation.

12.2.       When you shop on the Websitewe will ask you to input and we will collect Personal Information from you such as your name, address, e-mail address, telephone number, product selections, credit card or other payment information and a password.

12.3.       We may also collect, and our third-party providers of content may collect information about where you are on the internet, your browser type, the country and telephone area code where your computer is located, the pages of the website that were viewed during your visit and any search items that you entered on our Website (“User Information”). We may collect this information even if you do not register with us.

12.4.      The reason that we monitor our Website and capture this information is to improve your shopping experience, enabling us to handle your order, process deliveries, make you aware of exciting offers and promotions and ensure that we can continue to provide a great on-line shopping experience to our customers.  To assist with this, we may store information about you using cookies which are files sent by us to your computer or other access device which we can access when you visit our site at some point in the future.  The cookies we use enable us to save your bag for later, track the opening of our emails amongst other things. 

12.5.       We confirm that any Personal Information that you provide to us and any User Information from which we can identify you is held in accordance with the registration we have with the Information Commissioner’s Office.

13. Liability and Indemnity

13.1.      This clause only applies to you if you are a consumer.

13.2.     If we breach these Terms or are negligent, we are liable to you for foreseeable loss or damage that you suffer as a result. By ‘foreseeable’ we mean that, at the time the contract was made, it was either clear that such loss or damage would occur or you and we both knew that it might reasonably occur, as a result of something we did (or failed to do).

13.3.     We are not liable to you for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage.

13.4.     Nothing in these Terms excludes or limits our liability for any death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability that the law does not allow us to exclude or limit.

13.5.     You are responsible for any misuse of the Website or breach of these Terms by you.

13.6.     We do not accept liability (except as otherwise set out in these Terms) for any errors and/or omissions contained in our Website and reserve the right to change information, prices, and descriptions of listed goods at any time with or without notice.

13.7     Nothing in these Terms affects your statutory rights

14. Errors and Omissions

14.1.     We have made every effort to ensure that the information on this Website and in any documentation, we may send you (“Information”) is accurate. However, we do not make any promises about the Information and we are not liable for any loss or damage, whether direct, indirect or consequential, which may happen as a result of relying on the Information, except where we are not allowed by law to exclude our liability.

15. Descriptions

15.1.     Descriptions of our Products are set out on the Website. Please read the descriptions carefully.

15.2.     Any pictures and images provided on the Website, including of packaging, are for illustration purposes only. Your Products and their packaging may vary slightly from those pictures or images.

15.3.     We cannot guarantee that the colours displayed on your device will match exactly the appearance of your Products. The colours of the Products displayed on the Website may vary depending on what device you are using and your settings.

15.4.     All sizes and measurements set out on the Website are as accurate as possible but there may be a small tolerance.

16.         Care Instructions

Where a Product has care instructions, you must follow these instructions. We are not liable for any loss or damage in the event that the instructions have not been followed.

17.  Intellectual Property Rights

17.1.       You acknowledge and agree that all copyright, designs, trademarks and all other intellectual property and material rights contained in and relating to this Website are the property of the Company or its licensors.  In accessing this Website, you agree that you may only download the content for your own individual and non-commercial use. You are not permitted to copy, broadcast, download, store (in any medium) transmit show or play in public adapt or change in any way the content of the Website or any of its pages for any purpose whatsoever without the prior written permission of the Company.

18. Trademarks

All trademarks, brand names, copyrights, Product names and trade names are the property of their respective owners and we do not authorise any use which infringes those rights. Subject to this, you may view, print and download from the Website for personal use only. Any other use of information or materials on the Website is strictly forbidden without obtaining our written agreement first.

19. General

19.1.     The laws of England and Wales apply to these Terms, although if you are resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country. Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that you can choose whether to bring a claim in the courts of England and Wales or in the courts of another part of the UK in which you live.

19.2.     If any part of these Terms is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you), the validity, legality or enforceability of any other part of these Terms will not be affected.

19.3.     We do not give any contractual rights to third parties, and the Contracts (Rights of Third Parties) Act 1999 will not apply to any contract between us.

19.4.     The Website may collect information on demographics and interests. You can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads using the Ads Settings.

19.5.     If you breach these Terms and we take no action; we will still be entitled to use our rights and remedies in any other situation where you breach these Terms. If we delay enforcing our rights under these Terms, we may still enforce them later.
